Working without a Work Permit — even unpaid volunteering or remote calls for a foreign company while sitting in a Phuket café — can lead to a THB 100,000 fine, imprisonment, and blacklisting.
Phuket has the third-largest concentration of foreign workers in Thailand after Bangkok and Chonburi. The Labour Office at Phuket Provincial Hall (Damrong Road) processes hundreds of applications per week, especially in the hospitality and tourism sectors.
Capital: THB 2,000,000 registered capital per foreigner. THB 1,000,000 if the foreigner is married to a Thai national. Capital must be paid-up.
Thai-to-foreign employee ratio: 4 Thais : 1 foreigner. Exemptions for BOI, Treaty of Amity, IEAT zones.
Required corporate docs: DBD certificate (≤6 months), VAT registration (Por Por 20), Por Ngor Dor 50 (annual tax return), social security registration, list of Thai employees with SSO contributions.
Office: physical address in Phuket with photos of signage, reception, and workplace. We help arrange compliant office photos.
From outside Thailand: apply at Thai Embassy/Consulate in your home country with company invitation letter, DBD certificate, financial statements. Single entry 90 days, then convert to extension in Phuket.
From inside Thailand (conversion): if you arrived on Tourist or Visa-Exempt, you can convert to Non-B at Phuket Immigration with at least 15 days remaining. Requires WP3 (Work Permit pre-approval) from Labour Office.
Multi-entry Non-B: 1 year, used by frequent business travellers — issued only at Thai Embassies abroad.
WP3 (Pre-approval): obtained before the foreigner enters Thailand or before converting visa. Required to apply for Non-B Visa.
WP10 (Work Permit Book): blue book issued after Non-B is granted. Contains job title, employer, valid period, and conditions.
Documents from foreigner: passport, photos, medical certificate (≤30 days, from Phuket hospital), educational certificates translated and certified, CV.
Documents from employer: DBD, VAT, financial statements, SSO records, list of Thai employees, photos of office in Phuket.
Processing: 10–15 working days for first-time WP. Renewals 5–7 days. Phuket Labour Office hours 8:30–16:30 Mon–Fri.

BOI Smart Visa: 4 years, no Work Permit needed (the Smart Visa itself is the work authorization), faster processing at One Stop Service Bangkok. Categories T (Talent), I (Investor), E (Executive), S (Startup).
LTR Visa: 10 years, includes Work Permit, 17% flat tax for Highly-Skilled Professionals. Ideal for remote workers and senior executives based in Phuket.
BOI-promoted companies in Phuket (mostly tech, MICE, training) have relaxed capital and 4:1 ratio requirements.
Thai staff on paper only: SSO contributions must show 3 consecutive months of real salary transfers. Officers cross-check SSO 1-10 filings against bank records.
Salary below the nationality minimum table: Western Europe/US/Canada/Australia THB 50,000; Japan/Korea THB 45,000; India/Middle East THB 35,000; ASEAN THB 25,000. Under-declaring to save tax is the single fastest way to get refused.
Job title reserved for Thai nationals: 40 occupations remain closed (tour guide, hairdressing, clerical/secretarial, manual labour, brokerage). Re-title the role to a managerial/technical scope that matches the actual work.
Office photos that look residential: no company signage, no desk with a nameplate, no visible staff. Officers reject villa 'offices' in Bang Tao and Cherngtalay routinely.
Degree not certified: educational certificates must be translated and legalised (MFA / Apostille after 28 February 2027) — a plain translation is refused.
Financial statements showing losses two years running, with no explanation letter from the accountant.
Medical certificate older than 30 days, or issued by a clinic not on the Phuket Provincial Health list.
Mismatch between TM.30 address, house-book address, and the WP workplace address.
Foreigner working without a permit: fine THB 5,000–50,000, deportation, and a 2-year ban on re-applying for a Work Permit.
Employer hiring an unpermitted foreigner: THB 10,000–100,000 per worker; repeat offence THB 50,000–200,000 per worker, up to 1 year imprisonment, and a 3-year hiring ban.
Working outside the scope stated in the WP10 (wrong employer, wrong location, wrong duties): treated as working without a permit.
Failure to notify a change within 15 days: THB 20,000 for the first offence.
Overstay: THB 500/day capped at THB 20,000, plus automatic blacklist of 1 year (self-reported) or 5–10 years (arrested).
90-day report (TM.47): every 90 days at Phuket Immigration. We handle this monthly batch for our clients.
Re-entry permit (TM.8): file before any departure — single THB 1,000, multiple THB 3,800. Without it, visa is cancelled on exit.
Personal income tax (PND.91): all foreigners with WP must file annually. We coordinate with tax advisors.
WP changes: any change in job title, salary, employer, or workplace must be filed at Phuket Labour Office within 15 days.
Renewal: 30 days before expiry. We start renewal at day 45 to avoid any gap.
Work Permit rules, reserved occupations and employer obligations: Department of Employment, Ministry of Labour (doe.go.th) and the Foreign Workers Management Emergency Decree B.E. 2560 as amended.
Visa extension, TM.30, TM.47 and re-entry rules: Immigration Bureau (immigration.go.th).
Legalisation of foreign degrees and supporting documents: Department of Consular Affairs, MFA (consular.mfa.go.th). Thailand's Apostille regime enters into force for Thailand on 28 February 2027.
