Visa + Work Permit — the two-document rule

To work legally in Thailand you MUST hold both: (1) a Non-Immigrant B visa (or other work-eligible visa like LTR, BOI Smart, Treaty of Amity), AND (2) a Work Permit issued by the Department of Employment.

Working without a Work Permit — even unpaid volunteering or remote calls for a foreign company while sitting in a Phuket café — can lead to a THB 100,000 fine, imprisonment, and blacklisting.

Company requirements to sponsor a Work Permit

Capital: THB 2,000,000 registered capital per foreigner. THB 1,000,000 if the foreigner is married to a Thai national. Capital must be paid-up.

Thai-to-foreign employee ratio: 4 Thais : 1 foreigner. Exemptions for BOI, Treaty of Amity, IEAT zones.

Required corporate docs: DBD certificate (≤6 months), VAT registration (Por Por 20), Por Ngor Dor 50 (annual tax return), social security registration, list of Thai employees with SSO contributions.

Non-B Visa application — from outside or inside Thailand

From outside Thailand: apply at Thai Embassy/Consulate in your home country with company invitation letter, DBD certificate, financial statements. Single entry 90 days, then convert to extension in Phuket.

From inside Thailand (conversion): if you arrived on Tourist or Visa-Exempt, you can convert to Non-B at Phuket Immigration with at least 15 days remaining. Requires WP3 (Work Permit pre-approval) from Labour Office.

Work Permit application at Phuket Labour Office

Ongoing compliance — 90-day reports, re-entry, tax
