What an English-Speaking Notary Public Means in Thailand

Thailand does not have a separate ‘Notary Public’ office in the way the United States, United Kingdom, Australia or most EU countries do. Instead, the Lawyers Council of Thailand grants a special accreditation called ‘Notarial Services Attorney’ to qualified Thai lawyers who pass an additional course and registration. A Notarial Services Attorney has the legal authority to perform exactly the same functions a Notary Public performs abroad: witnessing signatures, certifying true copies, certifying translations, administering oaths for affidavits and statutory declarations, and authenticating corporate documents.

For expats living in Phuket — whether you own a villa in Bang Tao, run a dive school in Chalong, captain a yacht out of Royal Phuket Marina, work remotely from a Patong condo, or have retired in Kata — you will sooner or later need a document notarised so it can be used in your home country, by an overseas bank, by a foreign court, or by an embassy. That is exactly where our English-speaking team comes in.

Every member of our Phuket notary team speaks fluent English, drafts certifications in English (or bilingual Thai-English), understands the wording requirements of UK, US, Australian, EU, Canadian, Singaporean, UAE and Hong Kong authorities, and can chain the document straight through Thailand’s Ministry of Foreign Affairs (MFA) Consular Department and your home embassy in Bangkok without you ever leaving the island.

Who Typically Needs This Service in Phuket

Phuket is home to one of South-East Asia’s largest expat communities, and the document needs we see every week reflect that diversity. Below are the most common client profiles and the notarial work they typically request.

  • Property owners selling, leasing or transferring villas and condos in Bang Tao, Laguna, Patong, Kata, Surin and Mai Khao who need a Power of Attorney notarised so a lawyer or family member can sign at the Land Office on their behalf.
  • Retirees on Non-Immigrant O / O-A / LTR visas who need Proof of Life, Proof of Address or pension affidavits notarised for their home pension authority (UK DWP, Australian Centrelink, US SSA, German DRV, etc.).
  • Digital nomads and remote workers in Patong, Rawai and Cherngtalay who need notarised passport copies, proof of address and KYC documents for crypto exchanges, neobanks (Wise, Revolut, N26) and overseas brokers.
  • Yacht owners and captains based at Yacht Haven, Boat Lagoon, Royal Phuket Marina and Ao Po Grand Marina who need notarised vessel ownership transfers, charter agreements, flag-state declarations and crew employment contracts.
  • International business owners — dive schools, Muay Thai gyms, restaurants, wellness retreats — needing notarised Company Affidavits, Board Resolutions and Letters of Authorisation for overseas branches, distributors or trademark filings.
  • Foreign nationals planning to marry in their home country who need a notarised Affirmation of Freedom to Marry / Single Status Declaration in English.
  • Parents on dependant visas notarising parental consent letters so their children can travel, study abroad or hold dual passports.
  • Inheritance and estate cases where a foreign executor needs Thai assets released — notarised POAs, death declarations and beneficiary affidavits.

Document Types We Notarise in English

Our scope of work covers every category of document a Notarial Services Attorney is permitted to handle under Thai law. The list below is non-exhaustive — if your home authority has a specific template, we can almost always work with it.

  • Affidavits and Statutory Declarations — single status, identity, address, residency, life certificate, lost passport, lost documents.
  • Powers of Attorney — general, special, irrevocable, durable, real-estate-specific, banking-specific, litigation-specific.
  • Certified True Copies — passport, national ID, driver licence, residence certificate, work permit, visa pages, marriage certificate, birth certificate, divorce decree.
  • Certified True Translations — Thai to English and English to Thai, plus 40+ other languages through our in-house translation desk.
  • Signature Authentication — contracts, MOUs, NDAs, share purchase agreements, employment contracts, charter agreements.
  • Corporate Documents — Company Affidavit (DBD certificate), Memorandum & Articles, shareholder list (Bor Or Jor 5), board resolutions, minutes of meetings, audited financial statements.
  • Real Estate Documents — title deed (Chanote) copies, sale and purchase agreements, long-term lease registrations, FET forms.
  • Bank-Related — bank reference letters, specimen signatures, proof of funds, source-of-wealth declarations.
  • Education & Employment — diplomas, transcripts, TEFL certificates, employment letters, salary certificates, experience letters.

On-Site Notary Service Across the Island

Phuket is large, traffic is unpredictable, and many of our clients simply cannot leave a villa, hotel, hospital or marina mid-day. That is why a significant share of our English notary work is delivered on-site: our attorneys travel to you with a portable seal, fresh stamp pad, witness paralegal and a printer if needed. Signing typically takes 15 to 30 minutes from arrival.

  • Patong, Kalim, Tri Trang — free on-site within a 3 km radius of Jungceylon.
  • Phuket Town, Chalong, Rawai, Nai Harn — on-site fee from THB 500.
  • Kata, Karon, Kamala, Surin — on-site fee from THB 1,000.
  • Cherngtalay, Laguna, Bang Tao, Mai Khao, Nai Yang, Naithon — on-site fee from THB 1,500.
  • All marinas — Royal Phuket Marina, Boat Lagoon, Yacht Haven, Ao Po Grand Marina — confirmed appointments same-week.
  • Hospitals — Bangkok Hospital Phuket, Bumrungrad, Siriroj, Mission Hospital — for bedside signings.

From Notary to Embassy: We Handle the Whole Chain

A notarised document on its own is rarely enough for use abroad. Most foreign authorities require a two-step (or three-step) authentication chain: Notarial Services Attorney → Ministry of Foreign Affairs Consular Department (Chaeng Wattana, Bangkok) → Embassy of the country where the document will be used. Some countries also require pre-translation into the local language, certified by a sworn translator.

Beginning in 2026 Thailand is a contracting state to the Hague Apostille Convention, which means documents bound for the 120+ Apostille countries can skip the embassy step and use a single Apostille certificate issued by MFA. We track the rollout closely and advise you whether your destination country accepts Apostille or still requires full embassy legalization.

In either route, our Phuket team manages the entire Bangkok leg on your behalf — courier in, queue, payment of official fees, courier back to Phuket — so you can stay on the island and receive the final stamped document at your door.

💡 Hague Apostille is live in Thailand from 2026 — for most Apostille countries this cuts legalization time from 2–3 weeks to 3–5 working days. Ask us whether your country qualifies before paying full embassy fees.

Transparent English-Language Pricing

We publish flat fees in English for every standard service. There are no hidden surcharges for foreign clients, no ‘tourist pricing’, and no commission added if you ask us to chain the document through MFA and your embassy. All fees come with an official tax invoice (VAT included) issued by a Thai registered law office, which you can submit to your employer or accountant.

Why Expats in Phuket Choose Us

There are many capable Thai law firms in Phuket, but very few specialise in international document work for English-speaking clients. The vast majority handle local court cases, Thai criminal defence or land transactions, and treat notarial work as an occasional add-on. We are the opposite — international document services are our core business, and our English-speaking notary practice is the busiest desk in our Phuket office.

  • Every attorney on the notary roster holds the Notarial Services Attorney accreditation from the Lawyers Council of Thailand.
  • Every certification, cover sheet and invoice is issued in English (or bilingual) by default.
  • Direct relationships with the British, US, Australian, German, French, Italian, Russian, Indian and Chinese embassies in Bangkok for fastest legalization turnaround.
  • In-house translation desk in 40+ languages including NAATI (Australia) and MoJ-approved Thai-court translators.
  • Free post-signing review for 30 days — if your destination authority requests a wording change, we re-notarise at no extra charge (where the wording issue is on our side).
  • Open 7 days a week with after-hours appointments for clients flying out the next morning.

Legal Standing & Compliance

All notarial certifications we issue carry the four mandatory elements required by foreign receiving authorities: (1) the official Notarial Services Attorney seal, (2) the attorney’s handwritten signature, (3) the attorney’s Lawyers Council registration number and Notarial registration number, and (4) the place and date of certification. Our certifications comply with the Lawyers Council Regulation on Notarial Services Attorneys B.E. 2551 and subsequent amendments.

Client identification follows global KYC standards — we verify each signatory against a primary photo ID (passport for foreign clients, Thai ID for Thai nationals) at the moment of signing. Where the document concerns a company, we additionally verify the signatory’s authority through a current DBD company certificate (≤ 6 months old) and the corporate seal.

คำถามที่พบบ่อย

Is a Thai Notarial Services Attorney recognised abroad?

Yes. Every country that maintains diplomatic relations with Thailand accepts certifications issued by a Notarial Services Attorney, usually after the document is also legalised by Thailand’s MFA Consular Department and the destination country’s embassy in Bangkok. From 2026 onwards, Apostille-member countries accept the certification with only an Apostille from MFA — no embassy step needed.

Can I notarise a document over Zoom or video call?

No. Thai law does not currently permit Remote Online Notarization (RON). You must be physically present in front of the attorney at the moment of signing. To make this convenient, we offer on-site service anywhere on Phuket — your villa, condo, hotel, office, marina or hospital bedside.

What ID do I need to bring?

An original valid passport is mandatory for all foreign clients. We also recommend bringing a second photo ID such as a driver licence, plus the original document to be notarised. For corporate signings, also bring a current (≤ 6 months old) DBD company certificate and the corporate seal.

Do you draft documents from scratch, or only notarise documents I bring?

Both. We can notarise a document you bring (after a wording review), or we can draft the document for you in English from a template — common requests include Single Status Affidavits, Proof of Life letters, Powers of Attorney, parental consent letters and corporate resolutions. Drafting is included in the quoted fee for most standard documents.

How long does the whole legalization chain take?

Notarisation: same day. MFA Consular: 1–3 working days (express) or 3–5 working days (standard). Embassy legalization: 2–10 working days depending on the embassy. Total realistic timeline: 5–14 working days from signing to completed document back in Phuket.

Can you issue a tax invoice in my company’s name?

Yes. We issue official Thai VAT tax invoices (ใบกำกับภาษี) in the name of any Thai or foreign company, with full legal address and tax ID. This is accepted by all accounting departments and is fully deductible for Thai-registered companies.

What if the receiving authority abroad rejects the wording?

For up to 30 days after signing, we re-notarise the document for free if the wording issue is on our side. If the wording change is requested by you or by a new requirement from the foreign authority, we offer a 50% discount on the re-notarisation fee.

Do you accept walk-ins, or is appointment mandatory?

We strongly recommend appointments so the right attorney with the right specialisation (corporate, real estate, maritime, family) is available. Walk-ins are accepted at our Phuket Town office during weekday business hours, subject to attorney availability — but waiting time can be up to 1 hour.

Can the attorney travel to my villa in Cherngtalay or Bang Tao?

Yes — this is one of our most-requested services. On-site fee from THB 1,500 covers travel within Cherngtalay, Laguna, Bang Tao, Surin, Mai Khao, Nai Yang and Naithon. The attorney brings the seal, certification sheets, witness paralegal and (on request) a portable printer.

What payment methods do you accept?

Thai bank transfer (Kasikorn, Bangkok Bank, SCB), Wise, Revolut, credit card (Visa / Mastercard, 3% surcharge), cash in THB, and corporate invoicing for repeat clients. Crypto payments (USDT) accepted for amounts above THB 20,000.

Is everything kept confidential?

Absolutely. All clients and documents are protected by Thai attorney-client privilege under the Lawyers Council Act. We store electronic copies on encrypted servers in Thailand and shred working paper copies after 30 days. We never share client information with third parties without written consent.

Do you also help with the Hague Apostille (live 2026)?

Yes. From the day Thailand’s Apostille service goes live, we route every eligible document through MFA’s Apostille window instead of the embassy. This is faster (3–5 working days vs 2–3 weeks) and cheaper. We confirm Apostille eligibility for your destination country before charging full embassy fees.
