The 3-Step Chain — What Actually Has to Happen

Most 'work permit problems' come from doing the steps out of order or from an under-qualified employer. Here is the actual sequence that produces a valid permit and a 1-year stay.

Step 1 — Non-B Business Visa: Applied at a Thai embassy abroad (Vientiane, Penang, and Kuala Lumpur are the reliable Phuket-adjacent options) using an employer invitation letter, company documents, and educational credentials. Alternative: change of status from Tourist / DTV to Non-B inside Thailand at Chaengwattana — slower but avoids a border run.

Step 2 — Work Permit at Ministry of Labour: Once in Thailand on the Non-B, the employer files WP.3 and WP.1 at the MOL office covering your work address (Phuket MOL is at Saphan Hin). The permit is issued as a blue book with your photo, allowed job title, and allowed work location.

Step 3 — 1-Year Extension of Stay: Before the Non-B's 90 days expire, we file for a 1-year extension at Phuket Immigration (Promthep Cape) using the work permit + employer's tax returns, VAT filings, and social security proof.

Employer Qualification — The Test That Most SMEs Fail

The single biggest blocker is not the foreigner's paperwork but the employer's balance sheet. Thai law requires the employer to show real substance before a foreigner can be added to payroll.

• THB 2 million registered + paid-up capital per foreign employee (evidence: DBD certificate + bank paid-in confirmation)
• 4 Thai employees registered with social security for at least 1 month per foreign hire
• Latest audited financial statements + latest 3 months VAT (PP.30) and withholding (PND.1) filings
• Office address on the DBD registration must match the work permit application address
• Exemptions: BOI-promoted companies, US Treaty of Amity, IEAT companies — different (lower) capital and headcount rules apply

Salary Floors by Nationality — What Immigration Actually Checks

Thai Immigration publishes minimum salary requirements for Extension of Stay based on the foreigner's nationality. Falling below the floor means the extension is refused even if the work permit itself is valid.

• US, UK, Canada, Australia, New Zealand, Japan: THB 60,000/month
• Western Europe (DE, FR, IT, ES, NL, BE, CH, AT, Scandinavia): THB 50,000/month
• Eastern Europe, Russia, South Korea: THB 45,000/month
• ASEAN, China, India: THB 25,000-35,000/month depending on country
• Verification: personal income tax filing (PND.91) must show the salary was actually paid

Common Refusal Reasons and How We Prevent Them

Phuket MOL and Immigration have specific, unwritten preferences that trip up applicants filing solo or using Bangkok-based agents unfamiliar with the office.

• Job title too vague: 'Manager' fails; 'Marketing Manager — Digital Advertising for Yacht Charter' passes
• Educational credentials not legalized: diploma must be MFA-legalized and translated to Thai
• Company signage missing at work address: MOL sometimes requests a photo of the signboard
• Photo not compliant: MOL requires 3x4 cm with company logo/signboard visible in background
• Tax filings behind: even 1 month of late VAT filing can trigger refusal

Ongoing Compliance — What Nobody Tells You About Year 2

The work permit is the beginning, not the end. Miss a deadline and you can lose both the permit and the visa in a single week.

• TM.30: Landlord/hotel must report you within 24 hours of each entry (we automate this with a template)
• 90-day reporting: Every 90 days, in person at Phuket Immigration or via app (we send calendar reminders)
• Work permit renewal: 30 days before expiry with updated tax filings and financials
• Change of job title / employer: Requires a new WP.3 filing — you cannot start new work before it's approved
