Interpreters and Notarial Services Attorneys
Where the signer does not understand the language of the document, the Notarial Services Attorney must be satisfied the signer understands it — the interpreter's role in signature attestation, affidavits and cross-border powers of attorney.
Does signing a power of attorney for a transfer require an interpreter?
On the day of signing, the grantor must understand the scope of authority granted. If signed abroad, it normally needs certification at a Thai embassy or by a local notary plus legalisation by the Department of Consular Affairs; on the registration day the attorney acts on the grantor's behalf.
Can a Notarial Services Attorney certify a document the signer cannot read?
Yes, where the content has first been interpreted to the signer, because the substance of signature attestation is that the person signed voluntarily and knew what they were signing. The safe practice is to have an interpreter present and record that fact in the certificate.
Does a Thai signer need an interpreter for an English affidavit?
They should have one. The deponent must understand what they are swearing to be true. Where the document is in English and the deponent is not comfortable in English, provide a Thai translation and have an interpreter explain it before the Notarial Services Attorney to reduce the risk of challenge abroad.
Should a cross-border power of attorney be bilingual?
It is not mandatory, but good practice is a single bilingual instrument in parallel columns so both the grantor and the receiving authority can read it, with a clause stating which language prevails in case of conflict.
How do interpreters and Notarial Services Attorneys work together?
Where the signer does not understand the language of the document, the Notarial Services Attorney must be satisfied the signer understands its substance and signs voluntarily. The usual approach is for the interpreter to read the whole document through in the signer's language in the attorney's presence, after which the certificate records the interpreter's name and language and the interpreter also signs. This matters most for cross-border powers of attorney and affidavits, since receiving authorities may reject documents with no record of interpretation.
