eIDAS QES — When You Actually Need Qualified Electronic Signatures

EU counterparties for regulated transactions (real estate, employment contracts, some financial instruments) require Qualified Electronic Signature under eIDAS Regulation 910/2014. Standard DocuSign is only Advanced (AES), not Qualified.

What Thai law actually says about electronic signatures

The Electronic Transactions Act B.E. 2544 (2001, as amended) gives electronic signatures legal effect in Thailand where the method used can identify the signer and indicate their approval, and is as reliable as appropriate for the purpose. Section 26 describes the stricter tier — a signature uniquely linked to and under the sole control of the signer, with any later alteration detectable — which is what a certificate-based digital signature or an audit-trail platform such as DocuSign or Adobe Sign is designed to satisfy.

Two practical limits matter. First, certain instruments still expect wet ink or registration before a Thai officer — most notably land transactions before the Land Department, and some family and succession documents. Second, the counterparty's own law governs whether the file is acceptable at their end: a US or EU counterparty may require a qualified electronic signature or a specific platform. Evidence pack — what you receive after the session

A notarial act is only as strong as the record behind it. After a remote or in-office signing we issue a single PDF bundle containing: the executed document with the tamper-evident seal applied, the notarial certificate identifying the signer, the identification method and the date and place of the act, the platform's completion certificate with IP addresses and timestamps, and — for remote sessions — a note of the video verification method used.

We retain the register entry as required for a Thai notarial services attorney, so a receiving bank, registry or court can later verify that the act was genuinely performed. If the destination requires further authentication, the same bundle is printed, certified as a true copy of the electronic original, and routed through MFA legalisation or apostille — which is the step most clients discover late, because a purely digital file with no physical seal cannot be legalised as-is.
