Medical Powers of Attorney and Consent Letters

Powers of attorney for treatment or record collection, consent letters for a child's travel or treatment, living wills refusing life-prolonging care, and signature notarization.

What must a Thai medical certificate contain to be accepted by authorities?

It should follow the Medical Council of Thailand format and show the patient's full name and identification number, the examination date, the physician's findings or opinion, the clinic or hospital name, the doctor's signature and the medical licence number. Certificates missing the licence number or the facility's seal are routinely rejected by receiving agencies and by the Department of Consular Affairs.

Can the hospital issue the medical certificate in English directly?

Most private hospitals and large public hospitals can issue English-language certificates, which removes a translation step. For consular legalization the document must still be a paper original carrying the physician's wet signature and the hospital seal. Photocopies or self-printed PDFs are not accepted for legalization.

What does someone else need to collect medical records on my behalf?

A power of attorney stating the purpose and the exact scope of data, together with certified copies of both parties' identity documents. Where the patient is a minor or unconscious, proof of legal guardianship or a court order is used instead. Health data is sensitive personal data under section 26 of the PDPA, so hospitals check the paperwork strictly.

Can lab results and imaging films be legalized?

The Department of Consular Affairs legalizes documents bearing an authorised signature of the issuing facility, so lab reports and radiology reports should be printed on hospital letterhead with the physician's or director's signature and the facility seal. Image files on CD or USB are not legalizable; use the written report as the primary document and attach the images as support.

What is the yellow vaccination booklet and who issues it in Thailand?

It is the International Certificate of Vaccination or Prophylaxis issued under the WHO International Health Regulations 2005. In Thailand it is issued by hospitals and international communicable-disease control points designated by the Department of Disease Control, and must carry the signature of the physician or authorised officer plus the issuing unit's stamp.

Do Thai vaccination documents need extra certification for use abroad?

The WHO-format certificate is accepted at destination health checkpoints without further certification. If you use it for a visa, school admission or employment file, the receiving body may require a translation certified by the Department of Consular Affairs, or notarization of the issuer's signature by a Notarial Services Attorney.

What vaccination document does a child need for a school abroad?

Use the maternal and child health booklet or an immunisation summary from the clinic listing each vaccine, the date given and the lot number. Ask the facility to issue the summary on letterhead with a physician's signature, because schools abroad rarely accept unauthenticated photocopies of booklet pages, then translate and certify as the school requires.

Who should translate medical documents?

A translator familiar with clinical terminology who preserves ICD codes, drug names and units exactly as in the original. The translation must carry the translator's certification of accuracy with name, signature and contact details. Where the recipient is a court, insurer or foreign government body, add Department of Consular Affairs certification or Notarial Services Attorney certification.

What is the difference between MFA translation certification and notarization?

The Department of Consular Affairs certifies that the translation matches the Thai or English original, which is what state bodies and embassies want. A Notarial Services Attorney registered with the Lawyers Council of Thailand certifies a signature, a true copy, or the translator's affidavit, which suits documents going to private parties, universities and foreign insurers.

My records exist only in the hospital's online portal. What can be legalized?

Ask the hospital to print the document on letterhead with an authorised signature and seal as a paper original, or to issue a letter confirming the authenticity of the electronic file. Legalization requires comparing the issuer's signature with the specimen on file, so patient-portal printouts are usually refused.

Can a policy bought outside Thailand be used for a Thai visa?

Often yes, provided the policy covers treatment in Thailand up to the prescribed limit and you present an insurer certificate stating the sum insured, period and scope in English. Some procedures require the Thai authority's own certification form to be signed by the foreign insurer, which may need signature certification, so start early.

What does a foreign insurer typically need to settle a Thai hospital claim?

The standard set is a medical certificate stating the diagnosis, the discharge summary, an itemized hospital bill, original receipts, a copy of the passport page with the entry stamp, and the signed claim form. Many insurers additionally require certified true copies or a notarized claimant signature.

Why do some claims require a notarized signature?

A cross-border claim form is a legally significant statement of fact, so the insurer wants proof that the signatory is genuinely the policyholder. Having a Notarial Services Attorney certify the signature after checking identity documents reduces refusals based on failure to verify identity.

What should a medical power of attorney state?

It should identify the grantor and attorney clearly, define the scope — consenting to procedures, obtaining records, dealing with insurers — state the period of effect, and carry signatures with witnesses. For use abroad, sign before a Notarial Services Attorney and then legalize at the Department of Consular Affairs and the embassy as the destination requires.

How do I prepare a consent letter for a child travelling or treated without a parent?

The parents or legal guardians sign a consent letter naming the child and the accompanying adult, defining the consent given — including emergency treatment — and the period covered, attaching copies of the signatories' identity documents or passports and the child's birth certificate, with the signatures certified by a Notarial Services Attorney. Airlines and hospitals abroad normally want an English version.

Is a living will refusing life-prolonging treatment effective in Thailand?

Yes. Section 12 of the National Health Act B.E. 2550 recognises a person's right to make a written declaration refusing public health services that only prolong dying in the terminal stage of life, and health professionals who follow that declaration are not held liable. Put it in writing, date it, have witnesses, and inform your family and hospital.

Can a medical power of attorney executed abroad be used in Thailand?

Yes, if it follows the origin country's chain — notarization by a Notary Public, then certification by the competent state authority or the Royal Thai Embassy — after which it is translated into Thai and the translation certified by the Department of Consular Affairs. Thai hospitals apply the scope as drafted and may ask for more if wording is unclear, so draft it comprehensively at origin.

What steps make a Thai medical certificate usable abroad?

Obtain the original certificate bearing the hospital seal, the physician's signature and medical licence number; translate it into the destination language; certify the translation at the Legalisation Division of the Department of Consular Affairs; then obtain an Apostille if the destination is a Hague Convention party, or destination-embassy legalisation if it is not.

Can I obtain a copy of my hospital records, and can the hospital refuse?

Patients have the right to access and obtain copies of their own personal data under the Personal Data Protection Act 2019, on submitting the hospital's request form with identification. The hospital may take reasonable processing time and charge a reasonable fee. Requests on behalf of another person need a power of attorney or proof of legal representation.

What must a medical certificate for a work permit state?

It must follow the Department of Employment's prescribed form, confirming the absence of the prohibited diseases listed in the applicable ministerial regulation, and carry the physician's signature and licence number. Confirm the clinic uses the latest form, as outdated versions are commonly rejected.

How should a medical consent letter for an unaccompanied minor be prepared?

As a consent letter from the person holding parental power, stating the scope of treatment consented to, the accompanying carer and contact details, signed before a notarial services attorney registered with the Lawyers Council of Thailand, then Apostilled or legalised for the destination so the receiving hospital accepts it.

What must a medical certificate for a Thai medical treatment visa contain?

It must state the patient's name exactly as in the passport, the diagnosis, the treatment plan and the length of stay required, the number of necessary companions, the estimated cost, and confirmation that the hospital has accepted the patient for treatment. It needs the hospital seal, the physician's signature and their Thai medical licence number. Issue it within 30 days of filing — embassies and Immigration routinely reject older certificates.

Can relatives obtain records for an unconscious patient?

Only where they can show lawful representative status — a court-appointed guardian, or authority under an advance directive or health-care power of attorney. Ordinary relatives are usually given only the information needed for care decisions, not the full record, because the Personal Data Protection Act treats health data as sensitive. Preparing a health-care POA in advance is the practical safeguard.

Is a living will legally effective in Thailand?

Yes, under section 12 of the National Health Act B.E. 2550. The maker must have full capacity when signing, must define precisely which life-prolonging interventions are declined in the terminal phase, and should have witnesses sign. Give copies to the regular treating hospital and to family carers — a directive nobody knows exists will not be applied in the emergency room.

How much health information may be shared with an insurer or employer?

Explicit consent is required, because health data is sensitive personal data under the Personal Data Protection Act. The consent should specify what is disclosed, to whom and for what purpose. An employer may receive only what is necessary to assess fitness for the role — typically pass or fail against health criteria, not the full diagnosis — and the patient may withdraw consent later.

What must a medical certificate say for a companion visa application?

Most missions expect the treating physician to state the patient name, diagnosis, treatment plan and expected duration of stay, plus an explicit line that the patient requires an accompanying carer. The letter should sit on hospital letterhead with the practitioner licence number, signature and seal, and then be translated and the translation legalised if the receiving authority asks for it.

What happens when a patient is too ill to sign consent documents?

Practice relies on a legal representative or an attorney appointed in a power of attorney signed earlier. Without an advance document, hospitals may follow next-of-kin rules, and property matters can require a court process. Preparing a power of attorney and advance directives early avoids that delay.

Can historical medical records from several years ago be obtained in Thailand?

Usually yes, under each hospital's medical-records rules, with a request filed by the patient or an attorney holding a power of attorney and identity documents. Retention periods differ and very old files may no longer exist, so state the exact years and document types needed to avoid repeat requests and fees.

How can several years of Thai hospital records be obtained for use abroad?

File a medical-records request with the hospital's records department with the patient's ID and a consent form under Thailand's personal data protection practice. If the patient is abroad, a power of attorney with certified signature is needed. Preparation often takes several working days because files are pulled from archives, after which translation and certification follow the receiving body's rules.

What should a referral for overseas treatment contain?

A treating physician's referral stating the diagnosis, key test results, current medication and the reason further treatment abroad is needed, with laboratory results and imaging in a format the receiving hospital can read, plus a cost estimate if it supports a visa filing. Every page should carry the doctor's signature and professional licence number.

How much lead time should a multi-layer medical document set be given?

Allow roughly two to four weeks, covering records retrieval, translation, the consular certification queue and the destination embassy queue. Add more where further tests or a fresh physician signature are needed.

How are medical documents obtained for a child or a patient unable to sign?

The person with parental authority or a court-appointed guardian signs instead, showing proof of relationship such as a birth certificate or court order together with identification. For overseas use, that authority document is translated and certified alongside the medical records.

Can a relative abroad give medical consent for a patient in Thailand?

Hospitals ask for proof of relationship and a power of attorney that states the scope of medical decisions. When signed abroad it must be notarised and then legalised by a Thai embassy or the Department of Consular Affairs before a Thai hospital will rely on it. A conscious patient's own consent always overrides the document, so prepare the paperwork before an emergency rather than during one.

Are Thai medical records accepted abroad without translation?

Rarely. Most foreign institutions require a translation with the translator's signature legalised at the Department of Consular Affairs, and several European countries insist on their own sworn translators. Imaging is usually exchanged as DICOM files separately from the written report. Confirm the receiving institution's format before paying for certification twice.
