What is longstay.tgia.org and how does it affect my filing?
It is the central system run by the Thai General Insurance Association listing policies issued for long-stay visa applicants. When a Thai insurer issues a policy and records it there, officers can verify the policy online, which removes disputes over forged or cancelled certificates. A policy bought abroad will not appear in that system, so you must instead submit the insurer certification form the notification prescribes.
Can an insurer void the policy if I did not declare a condition?
Yes. Section 865 of the Civil and Commercial Code makes the contract voidable where the insured knew facts that would have led the insurer to charge a higher premium or to decline the risk and concealed them or made a false statement. The insurer may avoid the contract within one month of learning the ground and within five years of the contract date. Complete the application form yourself and truthfully rather than leaving it to an agent.
If the policy exists in Thai and English, which version governs?
Check the policy itself. Policies issued in Thailand usually state that the Thai text governs, because policy forms and wording require the Registrar's approval under the Life Insurance Act B.E. 2535 and the Non-Life Insurance Act B.E. 2535. Ask for both versions and have a lawyer compare them before signing, especially the exclusions and the definitions of accident and medical necessity.
After a death in Thailand, what do foreign heirs need to claim life cover?
The core pack is the death certificate issued by the district registrar, the hospital's certificate of death, the original policy, evidence of the beneficiary's relationship, and a court order appointing an estate administrator where no beneficiary was named. Thai official documents used abroad must be translated, legalised by the Department of Consular Affairs and then endorsed by the destination country's embassy.
What does compulsory motor insurance cover, and is it required for every vehicle?
The Protection for Motor Vehicle Accident Victims Act B.E. 2535 requires every vehicle owner to maintain cover. Victims receive initial compensation set by the ministerial regulation in force without waiting for fault to be proved, and the balance once liability is established. Those sums are revised periodically, so verify current figures with the OIC at oic.or.th. This cover addresses death and bodily injury, not vehicle repair.
Am I covered if I drive on an International Driving Permit and crash?
You are covered if, at the time of driving, you hold a licence valid under Thai law — a Thai licence, or an unexpired International Driving Permit issued under a convention Thailand is party to, together with your home licence. Standard policies exclude driving without a licence or after revocation, and driving over the legal alcohol limit, where the insurer may also recover from the driver.
What paperwork should I keep after a road accident in Thailand?
The police daily record identifying the parties and circumstances, the surveyor's claim slip, photographs of the scene and damage, medical receipts with a medical certificate, and copies of the driving licence and vehicle registration. If the other party is a foreigner or you settle privately, put the settlement in writing in both languages to prevent later disputes.
I bought travel insurance and then changed my flights — must the policy change?
Tell the insurer and obtain an endorsement amending the dates. If the cover period does not match the actual travel dates, a consulate may treat the file as incomplete, and an incident outside the period can be declined. Add at least a day of cover before departure and after return to absorb delays and connections.
How do I claim for flight delay and lost baggage?
You need airline evidence: a written delay confirmation, or a property irregularity report issued at the airport, plus boarding passes, baggage tags and receipts for necessary expenses incurred while waiting. The policy sets a minimum delay in hours and per-item caps in its schedule, so keep every receipt and notify within the reporting deadline stated in the conditions.
Can social security replace private health insurance?
Not entirely. Social security ties you to the hospital named on your entitlement card and to its referral rules, whereas private cover offers wider hospital choice and room benefits by plan. Many people run both. Note that some visa criteria accept proof of Thai social security covering treatment in Thailand in place of a policy, so read the criteria for your visa case by case.
The insurer declined my claim — what should I do first?
Ask for the refusal in writing with the reason and the policy clause relied on, then compare it against the schedule's conditions and exclusions. Appeal internally with further evidence such as your treating doctor's opinion. If that fails, complain to the OIC. Keep dated copies of every exchange: they are evidence and they help you manage the two-year limitation period in section 882.
How do I complain to the OIC, and does it cost anything?
Complain through the OIC hotline 1186, the online channel at oic.or.th, or in person at the OIC head office or a regional or provincial office. There is no fee for the complainant. Attach the policy, the insurer's refusal, medical or loss evidence and a timeline of contacts. Officers will call the parties to explain and mediate under the applicable regulations.
When is OIC insurance arbitration a good option?
It suits disputes where the facts are clear but the parties read the policy wording differently and you want a faster, cheaper route than litigation. The policyholder elects to refer the dispute under the OIC arbitration regulations, and the award binds under the arbitration legislation. Take legal advice before choosing arbitration over court.
What does suing an insurer in a Thai court involve, and in what language?
Proceedings are in Thai; foreign-language documents need certified translations, and the court arranges an interpreter where a party does not understand Thai. Key evidence is the policy and endorsements, the application form, the refusal letter, medical records and premium payment proof. Many insurance disputes qualify as consumer cases, whose procedure is lighter on the consumer than ordinary civil procedure.
Where can I complain if an insurer denies a claim?
File with the Office of Insurance Commission (OIC), which operates a hotline and an insurance dispute mediation process; attach the policy, the denial letter and medical evidence. If mediation fails, a consumer case can still be filed in court.
What health cover is required for a Non-O-A extension of stay, and are foreign policies accepted?
Applicants must show a policy covering treatment in Thailand at the sums announced and in force on the filing date, for both outpatient and inpatient treatment. Thai insurers in the central scheme issue certificates that immigration can verify instantly. Foreign policies are accepted when the insurer issues the prescribed certification form stating the sums insured and a coverage period spanning the requested extension, with an English or Thai translation. Many immigration offices also ask the insured to sign every page of the copies.
Can an insurer void the contract over an undisclosed pre-existing condition?
Under the Civil and Commercial Code an insurance contract is voidable where the insured knew and concealed a material fact that would have led the insurer to charge a higher premium or decline the risk. The insurer must exercise avoidance within one month of learning of the ground and in any case within five years of the contract date. Beyond those limits, or where the insured genuinely did not know the fact at the time, avoidance is improper. Ask for the reasons in writing and keep medical records showing the first date of diagnosis.
A claim was declined — where can a complaint be filed and how long does it take?
First obtain a written declination citing the policy clause and reasons, then use the insurer's complaints channel. If unresolved, complain to the Office of Insurance Commission through the 1186 hotline or the online intake, attaching the policy, the declination letter, treatment records and receipts. The Office operates mediation and arbitration procedures that are faster and cheaper than litigation. The general limitation period for suing on an insurance contract is two years from the date of loss.
What is the difference between class 1, 2+ and 3 motor cover, and what does compulsory insurance cover?
Compulsory insurance under the Road Accident Victims Protection Act covers death and bodily injury of accident victims only, never the vehicle. Voluntary class 1 covers the insured's own vehicle even at fault and includes theft and fire. Class 2+ covers own damage only in a collision with an identified land vehicle. Class 3 covers third-party liability only. The right choice depends on the value of the vehicle and the risk the owner can absorb.
The policy does not match what the agent promised — what can be done?
A newly issued policy can be cancelled within the free-look period stated in the conditions, counted from receipt, with premium refunded under the applicable rules. After that period, gather evidence of the sales presentation — chat messages, sales material and call records — and file with the insurer and the Office of Insurance Commission, which licenses agents and brokers. Verify a seller's licence status before signing anything.
How are pre-existing conditions treated under Thai health policies?
Standard OIC approved health policies exclude conditions existing before the policy started and impose waiting periods, commonly 120 days for conditions such as tumours and stones. Applicants must disclose their medical history truthfully: non-disclosure allows the insurer to void the contract within two years of inception under the Civil and Commercial Code and to refuse the claim.
What can I do if an insurer refuses to pay a claim in Thailand?
Complain to the Office of Insurance Commission on hotline 1186 or through its online complaint system, attaching the policy, receipts, medical records and the insurer's refusal letter. The OIC offers mediation and arbitration at no cost to the policyholder. Consumer court proceedings, which are exempt from court fees in many cases, are the last step rather than the first.
My insurer refused a claim. How do I escalate it in Thailand?

Do dependants need separate policies or is a family plan enough?
A family plan is acceptable, but the certificate must show each insured person by name with individual limits rather than a combined family sum, because officers check per-person coverage. If the system issues only a combined certificate, request individual certificates as well.
How can I verify that an insurer is properly licensed in Thailand?
Check the licensed-company database of the Office of Insurance Commission or call 1186. For long-stay applications also confirm the insurer appears in the verification system used by immigration, since a licensed insurer outside that system may force you to submit extra evidence.
