Claim documents and legalising insurance paperwork abroad
The claim pack for medical expenses, medical certificates and receipts foreign insurers require, translation and legalisation at the Department of Consular Affairs, notarised copies by a Notarial Services Attorney, and powers of attorney to file a claim for you.
Must LTR visa insurance be bought in Thailand?
No. The criteria BOI publishes at ltr.boi.go.th allow a health policy with cover of not less than USD 50,000 valid for your stay in Thailand, or proof of Thai social security entitlement covering treatment in Thailand, or a deposit in the amount the criteria specify. A foreign policy is acceptable if it states clearly that treatment inside Thailand is covered and comes with a Thai or English translation.
What is the limitation period for an insurance claim in Thailand?
Section 882 of the Civil and Commercial Code sets two years from the date of the loss for claiming indemnity, and two years from the due date for claiming premium. If negotiations drag toward the two-year mark, take legal advice on filing suit or on steps that interrupt the limitation period — do not rely on the insurer's internal review alone.
What documents does a foreign insurer need for treatment received in Thailand?
Normally the insurer's claim form, a medical certificate stating diagnosis and treatment, original receipts with the itemised billing summary, copies of your passport and entry stamp, and a medical record summary on request. Thai-language documents usually need an English translation, and many insurers ask for a certified translation or copies certified by a Notarial Services Attorney.
Does a medical certificate need legalisation at the Department of Consular Affairs?
It depends on the recipient. For a foreign government body or court, the document is usually translated, legalised by the Legalisation Division of the Department of Consular Affairs, then endorsed by the destination country's embassy. For a private insurer, many companies accept a translation certified by the translator or a lawyer. Ask the insurer for its requirement in writing before starting the legalisation route.
Can someone file the claim while the patient is still in hospital?
Yes, with a power of attorney that states the scope: obtaining medical records, submitting the claim, and receiving the cheque or transfer. Attach certified copies of the ID or passport of both the grantor and the attorney. Most hospitals also require a separate consent to disclose patient information, because medical records are sensitive personal data under the personal data protection law.
After a death in Thailand, what do foreign heirs need to claim life cover?
The core pack is the death certificate issued by the district registrar, the hospital's certificate of death, the original policy, evidence of the beneficiary's relationship, and a court order appointing an estate administrator where no beneficiary was named. Thai official documents used abroad must be translated, legalised by the Department of Consular Affairs and then endorsed by the destination country's embassy.
What paperwork should I keep after a road accident in Thailand?
The police daily record identifying the parties and circumstances, the surveyor's claim slip, photographs of the scene and damage, medical receipts with a medical certificate, and copies of the driving licence and vehicle registration. If the other party is a foreigner or you settle privately, put the settlement in writing in both languages to prevent later disputes.
Can older travellers or people with chronic illness buy travel cover?
Yes, though many plans cap the insured age and exclude treatment arising from pre-existing conditions. Read the exclusions and look for plans offering a chronic-condition extension. Carry a medication list and an English-language medical certificate, because the insurer's assistance centre will ask for clinical details before approving cashless treatment abroad.
How do I claim for flight delay and lost baggage?
You need airline evidence: a written delay confirmation, or a property irregularity report issued at the airport, plus boarding passes, baggage tags and receipts for necessary expenses incurred while waiting. The policy sets a minimum delay in hours and per-item caps in its schedule, so keep every receipt and notify within the reporting deadline stated in the conditions.
Can a foreigner be named as beneficiary on a Thai policy?
Yes; life policies place no nationality limit on beneficiaries. Write the name exactly as in the passport and state the relationship and date of birth to avoid identification problems at claim time. Where the beneficiary is abroad, identity documents and a power of attorney executed overseas must be notarised and then legalised by a Royal Thai Embassy or through the process the recipient requires.
The insurer declined my claim — what should I do first?
Ask for the refusal in writing with the reason and the policy clause relied on, then compare it against the schedule's conditions and exclusions. Appeal internally with further evidence such as your treating doctor's opinion. If that fails, complain to the OIC. Keep dated copies of every exchange: they are evidence and they help you manage the two-year limitation period in section 882.
What does suing an insurer in a Thai court involve, and in what language?
Proceedings are in Thai; foreign-language documents need certified translations, and the court arranges an interpreter where a party does not understand Thai. Key evidence is the policy and endorsements, the application form, the refusal letter, medical records and premium payment proof. Many insurance disputes qualify as consumer cases, whose procedure is lighter on the consumer than ordinary civil procedure.
How must a foreign policy be translated and certified for filing?
If it is not in English, translate it into Thai or English and certify the translation as the receiving authority requires. Some offices accept only a confirmation of benefits on insurer letterhead signed by an authorised officer. For court or other official use, signature certification and an Apostille at origin may be needed.
What documents are needed to reclaim Thai treatment costs from a foreign insurer?
Typically original itemised receipts, a medical report or discharge summary signed by the physician with their licence number, and copies of your passport and entry stamp. If the insurer requires certified documents, an English translation certified by the Department of Consular Affairs may be needed.
Where can I complain if an insurer denies a claim?
File with the Office of Insurance Commission (OIC), which operates a hotline and an insurance dispute mediation process; attach the policy, the denial letter and medical evidence. If mediation fails, a consumer case can still be filed in court.
What health cover is required for a Non-O-A extension of stay, and are foreign policies accepted?
Applicants must show a policy covering treatment in Thailand at the sums announced and in force on the filing date, for both outpatient and inpatient treatment. Thai insurers in the central scheme issue certificates that immigration can verify instantly. Foreign policies are accepted when the insurer issues the prescribed certification form stating the sums insured and a coverage period spanning the requested extension, with an English or Thai translation. Many immigration offices also ask the insured to sign every page of the copies.
Can an insurer void the contract over an undisclosed pre-existing condition?
Under the Civil and Commercial Code an insurance contract is voidable where the insured knew and concealed a material fact that would have led the insurer to charge a higher premium or decline the risk. The insurer must exercise avoidance within one month of learning of the ground and in any case within five years of the contract date. Beyond those limits, or where the insured genuinely did not know the fact at the time, avoidance is improper. Ask for the reasons in writing and keep medical records showing the first date of diagnosis.
A claim was declined — where can a complaint be filed and how long does it take?
First obtain a written declination citing the policy clause and reasons, then use the insurer's complaints channel. If unresolved, complain to the Office of Insurance Commission through the 1186 hotline or the online intake, attaching the policy, the declination letter, treatment records and receipts. The Office operates mediation and arbitration procedures that are faster and cheaper than litigation. The general limitation period for suing on an insurance contract is two years from the date of loss.
How can a departing foreigner claim social security old-age benefits?
An insured person who has ceased insured status and meets the statutory conditions may claim old-age benefits by filing the benefit application with a passport copy, evidence that insured status ended, and bank account details. Those who have already left Thailand usually appoint a representative in Thailand, and a power of attorney signed abroad must go through signature certification and legalisation before it can be used.
What documents are needed to claim Thai treatment costs from a foreign insurer?
Typically a medical certificate stating the diagnosis and treatment dates, a medical summary or discharge summary, original itemised receipts, and the insurer's claim form signed by the treating doctor. Insurers abroad usually require a certified English translation, and in some cases legalisation by the Department of Consular Affairs or that country's embassy. Photocopy every receipt before sending originals.
The patient cannot sign — can a relative handle the claim?
Hospitals and insurers generally require a power of attorney stating clearly that the attorney may request medical records, sign claim forms and receive claim proceeds, with signed copies of both parties' identity documents or passports. If the principal is abroad, the mandate must be signed before a notary public or Thai consular officer and pass through the certification chain first. Where the patient is unconscious, proof of relationship and the hospital's own procedure apply case by case.
Are floods and natural perils covered by property policies in Thailand?
Standard residential fire policies usually include natural perils — flood, windstorm, earthquake and hail — within a limited annual sub-limit. Higher limits require an extension. Check exclusions relating to water level, high-risk zones and any waiting period after inception, and keep photographs and valuation documents of the property in advance to support a claim.
Does a small business need third-party liability cover?
Businesses that receive customers on their premises — restaurants, clinics, tutoring schools and accommodation — face claims arising from accidents on site. Third-party liability cover responds to death, bodily injury and property damage of others up to the sum insured, including defence costs subject to conditions. Set the limit by reference to daily footfall and the nature of the hazard. Many shopping-centre leases already require tenants to hold this cover.
The policy does not match what the agent promised — what can be done?
A newly issued policy can be cancelled within the free-look period stated in the conditions, counted from receipt, with premium refunded under the applicable rules. After that period, gather evidence of the sales presentation — chat messages, sales material and call records — and file with the insurer and the Office of Insurance Commission, which licenses agents and brokers. Verify a seller's licence status before signing anything.
Which time limits matter most in Thai insurance matters?
The common ones are notifying the insurer without delay as the policy requires, submitting claim documents within each policy's deadline, the insurer's right to avoid the contract within one month of learning the ground and no later than five years from inception, and the two-year limitation period for suing on an insurance contract from the date of loss. Claims for initial compensation under the Road Accident Victims Protection Act have their own separate deadline. Record the incident date and every filing date.
How should beneficiaries be named in a life policy to avoid problems at claim time?
State full names as in official documents, the relationship, and the share for each person, with shares totalling the whole benefit, and update the nomination when family circumstances change. Where no beneficiary is named, proceeds fall into the estate and cannot be released until an estate administrator is appointed by court order, which takes far longer. Foreign policyholders should check that spellings match the passport to avoid identity verification problems.
How are pre-existing conditions treated under Thai health policies?
Standard OIC approved health policies exclude conditions existing before the policy started and impose waiting periods, commonly 120 days for conditions such as tumours and stones. Applicants must disclose their medical history truthfully: non-disclosure allows the insurer to void the contract within two years of inception under the Civil and Commercial Code and to refuse the claim.
What can I do if an insurer refuses to pay a claim in Thailand?
Complain to the Office of Insurance Commission on hotline 1186 or through its online complaint system, attaching the policy, receipts, medical records and the insurer's refusal letter. The OIC offers mediation and arbitration at no cost to the policyholder. Consumer court proceedings, which are exempt from court fees in many cases, are the last step rather than the first.
Can I use a health policy bought abroad for a Thai visa application?
Often yes, but officers usually require an English confirmation letter naming the insured, showing coverage dates that span the whole permitted stay, inpatient and outpatient limits, and an explicit statement that treatment in Thailand is covered. Documents in other languages need a certified Thai or English translation, and some checkpoints also ask for legalisation by the Department of Consular Affairs. Our advisers review the wording against the exact checkpoint requirements before you file.
What should foreigners watch out for with Thai motor insurance?
Compulsory insurance under the Protection for Motor Vehicle Accident Victims Act covers only bodily injury within limited sums and never the vehicle. Voluntary cover must list the actual drivers; if a driver holds a foreign licence that is not recognised under the applicable convention, the insurer may refuse the claim. Translate and certify the licence or convert it to a Thai licence first.
My insurer refused a claim. How do I escalate it in Thailand?
Ask for a written refusal citing the policy clause, collect receipts, medical records and correspondence, then file with the Office of Insurance Commission hotline 1186 or a regional office for mediation. If mediation fails, arbitration or a consumer court claim follows. All foreign-language evidence needs certified translation.
What do I need to claim treatment I already paid for overseas?
Original receipts, an itemised bill, a doctor's letter stating the diagnosis and treatment dates, and travel evidence for that period. Foreign-language documents need certified translation, and some insurers require certification by an authority in the treating country. Watch the filing window, commonly 30 to 90 days from treatment.
I would rather not compare policies and prepare paperwork myself. How can your team help?
Our advisory team has handled foreigner documentation and applications for more than 15 years. We start from the exact rules of the office you will file with, review the policy wording clause by clause, assemble the file with certified translations and any required legalisation, and can file on your behalf. If a dispute with the insurer arises we draft the correspondence and liaise with the regulator. Contact us by phone or LINE for a case assessment.
