Guardian visa vs dependent visa — the practical difference

Both sit under the Non-Immigrant O category, but they rest on different qualifying facts. The guardian route rests on the child's student status: a Ministry of Education-licensed school issues a letter naming the parent or guardian who is applying. The dependent route rests on the principal family member's own status — a husband holding a Non-B with a valid work permit, or a wife on a retirement extension.

That difference drives the paperwork. Guardians resubmit school documents every year: enrolment confirmation, tuition receipts, and attendance or academic records. Dependents resubmit the principal applicant's documents: current visa and work-permit pages, company certification, and tax evidence.

The most misunderstood point is the end date. A dependent's or guardian's permission never runs past the principal applicant's permitted stay or the academic year it is tied to. If the principal's extension is shortened or cancelled, the family members are affected on the same day.

Who qualifies as a guardian

The core case is a legal parent of a student holding a Non-ED visa at a properly licensed institution. Legal guardians who are not parents — grandparents or an appointed guardian — must produce a court order or a properly legalised instrument granting custody, not a simple consent letter. This is one of the most common causes of rejection.

Where the parents are separated or divorced, expect to add the divorce judgment or custody agreement to prove that the applicant genuinely holds care of the child.

Relationship documents: certification, translation, legalisation

Foreign civil documents cannot be used in Thailand as issued. They must be authenticated in the country of origin, translated into Thai (or English, then Thai where required), and legalised by the Department of Consular Affairs of the Thai Ministry of Foreign Affairs.

Thailand's accession to the Hague Apostille Convention takes effect on 28 February 2027, after which documents from member states can travel on an Apostille rather than the embassy legalisation chain. The certified Thai translation requirement remains in place for most Thai authorities.

Financial and address evidence

Address evidence must be internally consistent: lease or title deed, a map, photographs showing the house number, and a TM30 address notification already filed by the house master or landlord. A single mismatch usually means the file is returned for correction before it is assessed.

Filing sequence, from abroad to annual extension

The smoothest path is to obtain the Non-Immigrant O through Thai e-Visa before travelling, which gives an initial 90-day permitted stay to prepare the extension. Changing visa category inside Thailand is possible in some cases, but requires enough days remaining under the applicable rules and is discretionary.

Once in Thailand, file form TM7 for a one-year extension of stay at the Immigration office covering the actual residence, roughly 30 to 45 days before expiry. Many offices issue a 30-day consideration stamp before granting the full year.

Obtain a re-entry permit before every departure. Leaving without one cancels the extension the moment you exit — by far the most common mistake among families travelling during school holidays.

Work rights and structural limits

Neither the guardian nor the dependent visa grants work rights. The qualifying fact can also disappear: a school transfer or the child's graduation ends the basis for the permission. The guardian must switch to another basis or depart before the permitted stay ends, because even a short overstay affects the next application.
