What rights does a foreign suspect have during the investigation stage?
The Criminal Procedure Code gives a suspect the right to meet and consult a lawyer in private, to have the lawyer present during questioning, to be informed of the allegation and of the right to remain silent, and to an interpreter if he cannot use Thai. The suspect may also apply for provisional release on security, and may have his embassy or consulate notified under the principle of consular access.
Does Thailand have a notary public in the common-law sense?
No. The closest office is the Notarial Services Attorney — a Thai lawyer registered with the Lawyers Council of Thailand under the Lawyers Act B.E. 2528 and the Council's regulations. Certifications issued by such an attorney are accepted by most authorities and embassies. Where the destination requires a further layer, the document then goes to the Department of Consular Affairs for legalisation.
How many steps are needed for a Thai legal document to be used abroad?
Currently three to four: first, produce or certify the original correctly, for example a certified extract from the issuing authority or signature certification by a Notarial Services Attorney; second, translate into the language the destination requires; third, legalisation by the Legalisation Division of the Department of Consular Affairs; and fourth, in many countries, a further certification by that country's embassy in Thailand.
When does the Apostille Convention take effect for Thailand?
Thailand has acceded to the HCCH Apostille Convention, which enters into force for Thailand on 28 February 2027. Until that date, documents still follow the existing legalisation and embassy chain. From then on, documents exchanged between Thailand and other contracting parties need only an Apostille certificate from the competent authority. Always confirm with the receiving body, as some still require a certified translation.
Who must certify the translation of a legal document?
It depends on the recipient. Thai authorities generally accept a translation signed and certified by the translator with contact details. For legalisation at the Department of Consular Affairs, the translation must match the original line by line in the format the Legalisation Division accepts. Can a foreigner sue in a Thai civil court, and is security for costs required?
Yes — foreigners have the same standing as Thai nationals and file through a licensed Thai attorney. Where the plaintiff has no domicile or assets in the Kingdom, the defendant may ask the court to order security for costs under the Civil Procedure Code, and the court weighs the plaintiff's connection to Thailand. Any foreign evidence must be legalized and translated into Thai before filing.
Can a foreign court judgment be enforced directly in Thailand?
No. Thailand has no general regime for recognizing foreign judgments, so the winning party must sue afresh in a Thai court on the underlying facts, using the legalized and translated foreign judgment as key evidence. Foreign arbitral awards are different — they are enforceable under the New York Convention. This distinction should drive your dispute-resolution clause at drafting stage.
I have been reported to the police in Thailand — what should I do first?
Say nothing substantive until a lawyer and an interpreter are present. A suspect has the right to consult counsel, to an interpreter if they do not understand Thai, and to remain silent. Then establish the exact charge, review bail conditions and security, and contact your embassy for consular assistance. Giving statements in Thai you did not fully understand is the single biggest source of problems later at trial.
How does divorce work when one spouse is foreign?
Two routes: administrative divorce by mutual consent at the district office, requiring a divorce agreement with two witnesses and both spouses attending; or a court divorce action where consent is absent or statutory grounds exist. Child custody, maintenance and division of marital property must be settled alongside. To use the outcome abroad, the divorce registration must be translated and legalized.
How do I make foreign documents admissible as evidence in a Thai court?
Have them certified by the issuing country's authority and the Royal Thai Embassy there — or apostilled where that route is available — then translated into Thai by a translator who signs the certification, and produce the originals for the court. If the other side challenges the translation, the court may appoint a neutral translator or require the translator to testify, so use one who can appear in court.
What should I do first if Thai police bring charges against me?
Stay calm and present identification as required. A suspect has the right to be informed of the allegation, the right to remain silent, the right to meet and consult a lawyer privately, and the right to an interpreter. Do not sign records you cannot read, ask for a copy, and you may contact your embassy under the Vienna Convention on Consular Relations. Arrange for a licensed Thai lawyer to attend the investigation as early as possible.
Can a foreigner sue in a Thai court, and what documents are needed?
Yes, foreigners can be parties before Thai courts. Courts typically require a passport, a power of attorney appointing Thai counsel if you will not appear personally, proof of identity or corporate existence, and documentary evidence translated into Thai with a translator's certification. A power of attorney signed abroad normally needs notarisation and embassy or consular legalisation. Proceedings are conducted in Thai, so an interpreter must be arranged for hearings, and uncertified translations can be challenged. What is required before a foreign court judgment can have effect in Thailand?
Not automatically. Thailand has no procedure that makes a foreign judgment immediately enforceable. A claimant normally files a fresh action in a Thai court and uses the foreign judgment as strong evidence. The bundle usually includes a certified copy of the judgment, a certificate that it is final, international certification by apostille or embassy route, and a Thai translation certified by the Department of Consular Affairs. Take legal advice first on limitation periods and the cause of action.
In a bilingual contract, which language should govern?
Include a clause stating which language prevails in case of conflict, together with the governing law and the forum for disputes. A frequent mistake is making English the governing text when the contract must be filed with a Thai authority that accepts Thai only, which forces a later translation and creates inconsistency risk. Producing the certified translation on the signing date avoids that.
How is an affidavit prepared for use in foreign proceedings?
The deponent prepares the text in the form required by the foreign lawyer, then signs before a Notarial Services Attorney in Thailand. The document then goes to the Department of Consular Affairs and on through the apostille or embassy route. What is needed to appoint a lawyer to litigate on my behalf?
The court's power of attorney form for counsel, signed by the party, with a copy of the identity document. A company must attach a recent certificate of incorporation and use the seal as registered.
Where does a Thai national obtain a certificate of single status for use abroad?
At the district office of registered domicile, using the identity card, house registration, and witnesses as the registrar requires. It is then translated into the destination language, the translation certified by the Department of Consular Affairs, and processed by apostille or embassy route as applicable. These certificates usually have a short acceptance window, so request one close to the time of use.
How do I start enforcing a contract against a counterparty abroad?
Begin with three clauses: governing law, dispute forum, and the notice mechanism. Serve notice exactly as the contract requires and keep proof of delivery. If proceedings follow, assess where the counterparty's assets sit, because winning in a forum where you cannot enforce achieves nothing. Have certified translations of the supporting documents prepared in advance.
Does a will made abroad cover assets in Thailand?
It can if validly executed, but applying it to Thai assets still requires a Thai court to appoint an estate administrator, supported by a certified translation and international certification. The cleaner approach is a separate Thai will for Thai assets, expressly stating that it does not revoke the foreign will covering assets elsewhere, so the two instruments do not cancel each other.
How can I verify that a certifying lawyer is genuinely authorised?
Check two things: the lawyer's licence number, and registration as a Notarial Services Attorney under the Lawyers Council regulations. Recipients can ask the Lawyers Council of Thailand to confirm registration status. Verify that the seal, signature, and registration number on the document match, since many receiving authorities compare the signature with a specimen on file.
Which legal mistake costs the most time on cross-border documents?
Doing the steps out of order, typically translating before the original is certified, which forces the whole chain to restart. Next is choosing the wrong route between apostille and embassy legalization without checking whether the destination is a Convention party, followed by inconsistent name spellings across documents. Getting the sequence right at the outset saves more time than rushing any single step.
