Marry in Thailand as a Foreigner — Complete 2026 Legal Guide (Marriage Equality Act)

What the 2025 Marriage Equality Act changed
The Marriage Equality Act (Amendment to the Civil and Commercial Code) entered into force on 22 January 2025, making Thailand the first country in Southeast Asia to fully recognise same-sex marriage. The Act replaced gendered language ('husband and wife') with neutral language ('marriage partners') across the entire Civil and Commercial Code.
For foreign couples, this means: any two adults (18+) of any gender combination can register a marriage at any amphur in Thailand, with identical legal effect — inheritance, adoption, spousal visa, joint property. Phuket amphurs (Mueang, Thalang, Kathu) all process same-sex marriages on the same forms and timeline as opposite-sex marriages.
The five-document legal chain for foreigners
Regardless of gender, every foreigner marrying in Thailand needs the same five core documents authenticated before the amphur will register the marriage:
- Passport (with valid Thai visa or visa-exempt entry stamp)
- Affidavit of Single Status (Affirmation of Freedom to Marry) from your embassy in Bangkok
- Certified Thai translation of the affidavit
- MFA legalization of the translated affidavit by the Department of Consular Affairs
- Two witnesses with Thai ID or passport (the law firm or amphur can provide them)
Embassy affidavit — country-by-country differences
The Affidavit of Single Status is the slowest step. Embassies vary widely in processing time and form. Common patterns:
- US Embassy Bangkok — self-sworn affidavit at the consular section, same-day, USD 50
- UK Embassy Bangkok — 'Notice of Marriage' takes 21 days posting period in UK; alternative is a UK statutory declaration
- Australia — statutory declaration sworn at the embassy, same-day, AUD 99
- Germany, France, Italy, Spain — full Certificate of No Impediment must come from the home country (4–6 weeks)
- China, India, Vietnam — embassy affidavit often requires home-country supporting documents
MFA legalization step
After the embassy affidavit is translated into Thai by a certified translator, the translation must be legalized by the Department of Consular Affairs (MFA) at Chaeng Watthana, Bangkok. Standard service is 2 working days; express (1 day) is available for a higher fee.
From mid-2026 onwards, foreign affidavits already bearing an Apostille from the home country can skip the embassy step entirely — the Apostille is accepted directly by Thai amphurs as proof of authenticity, but the Thai translation step remains mandatory.
Registration day at the Phuket amphur
Registration is free of charge at any amphur in Thailand. In Phuket, most foreign couples register at Amphur Mueang (Phuket Town) or Amphur Thalang (north Phuket, near the airport). The appointment takes about 60 minutes and produces three certificates:
- Khor Ror 2 — Marriage Registration Record (kept by the amphur)
- Khor Ror 3 — Marriage Certificate (issued to the couple, used as the primary marriage proof)
- Khor Ror 4 — Marriage Status Endorsement (added to each spouse's household registration if Thai)
Optional but recommended: prenuptial agreement
Under Thai law, a prenuptial agreement (Sin Suan Tua agreement) is enforceable only if it is filed at the amphur on the same day the marriage is registered. Filing one day later makes it void. The agreement defines which assets remain personal (Sin Suan Tua) and which become marital (Sin Somros), and it can override Thailand's default community property regime.
For couples with significant pre-marriage assets — Phuket villas, overseas property, business shares — the prenup is often more important than the marriage certificate itself.

A Thai marriage certificate (Khor Ror 3) is valid worldwide once it has been translated into English (or the destination language) and authenticated. The chain mirrors the inbound documents:
- Certified English translation by a Thai certified translator
- MFA legalization of the translation at Chaeng Watthana
- From mid-2026: Apostille from MFA — accepted directly in 125+ Hague countries
- For non-Hague countries: additional embassy authentication of the home country in Bangkok
